Effective October 28, 2004, the most sweeping banking law change in at least the last 100 years went into effect.  As a result of Check 21, checks may clear the same day they are written.  Bad checks may skyrocket.  For more information CLICK HERE.

Privacy Regulations

In October, 1999, the Gramm-Leach-Biley Financial Services Modernization Act became law.  The primary purpose of this law was to allow banks, insurance companies and investment companies to merge together to form "financial supermarkets".  As this law was being debated, concern was expressed that there could be an intrusion into the privacy of individuals because of the information tht might be passed back and forth.  In an attempt to head this off, the law included various provisions designed to restrict, to some degree, the information that could be given out.  As a result of this, many banks misinterpreted the privacy provisions.  They erroneously believe that they can no longer verify funds for purposes of redepositing NSF checks.  The Federal Trade Commission is responsible for administering much of this law.   The FTC has published information explaining that the privacy provisions do not apply to verifying funds for redeposit purposes.  To review the correct understanding of this interpretation CLICK HERE.
